A 59-year-old housewife was sentenced to one month in jail, suspended for 24 months, after being convicted of throwing or placing faeces and other offensive substances at a downstairs neighbour’s property and damaging a CCTV camera. The Eastern Magistrates’ Court also ordered Sun Siu-fong to pay about HK$2,900 in compensation on August 21, 2026.
Sun was convicted after a trial of one charge of criminal damage and another involving the throwing or placing of faeces, dirt, foul-smelling or otherwise offensive substances on private property without the owner’s or occupier’s consent.
The case involved faeces being dumped or thrown into a downstairs neighbour’s air-conditioner bay. The criminal damage incident took place on May 31, 2025, while the charge concerning the offensive substances covered the period from June 6 to July 13, 2025.
The CCTV camera had been installed on a window ledge beside a light well on the floor immediately below Sun’s flat. It was pushed down and stopped functioning. The magistrate said Sun had checked the corridor, made a pushing movement near the camera and left quickly, indicating a clear intention. The act also created a risk of an object falling from height.
The magistrate said the case was not an ordinary hygiene problem but involved systematic and continuing harassment. The conduct intruded on the neighbour’s living environment and quality of life, requiring repeated cleaning while causing mental pressure and concern that it could happen again.
In mitigation, the defence said Sun had physical and mental health problems. A report found her unsuitable for a community service order and did not recommend a probation order. The defence also said she relied on monthly Comprehensive Social Security Assistance of just over HK$6,000 and could not afford the prosecution’s requested compensation of more than HK$14,000.
The magistrate said the suspended sentence represented the maximum and final leniency, and warned Sun to deal with problems lawfully and rationally and not to offend again.
