A 37-year-old MPF intermediary has been convicted of six offences over early-withdrawal claims totalling HK$4.6 million. The District Court found him guilty of four counts of conspiracy to defraud and two counts of using false instruments on 22 October 2026.
The Independent Commission Against Corruption said that between July 2021 and November 2022, the intermediary helped clients open MPF accounts with Sun Life Trustee Company Limited, transfer their funds there and apply to withdraw them early. The applications claimed the clients intended to move to mainland China and leave Hong Kong permanently. Its investigation found they had never settled there and had no intention of doing so.
Documents included declarations that appeared to have been signed before a lawyer and employment contracts for jobs with a purported mainland employer. The ICAC said the lawyer had not witnessed any declarations for the clients, who had not been employed by that employer.
Three clients had earlier admitted, between them, one count of conspiracy to defraud and three counts of using false instruments.
The case is due back on 5 November for mitigation, with sentencing scheduled for 26 November. The ICAC has also applied to confiscate the intermediary’s alleged proceeds; that application is awaiting a court date.
