Dentist Dr Tang Kon Yiu has applied for judicial review of a decision by the Dental Council of Hong Kong to allow an expert report to be used in disciplinary proceedings against him. He is asking the High Court to quash the Council’s decision to introduce the report, or its refusal to exclude it.
The disciplinary case followed orthodontic treatment provided to a patient by Tang between 2019 and 2021. The patient was dissatisfied with the result, another orthodontist took over the treatment in 2022, and the patient complained to the Council in 2023. Tang has practised as a dentist since 2010.
The Council brought six charges based on the complaint and the opinion of the patient’s treating doctor. In his court application, Tang said he sought legal advice and decided to admit all six charges. The disciplinary hearing was scheduled for June 25, 2026.
The dispute before the High Court concerns evidence in that disciplinary process. The Council introduced an expert report without notifying Tang in advance and rejected his request to have it excluded. Tang says the late introduction was unfair, that the Council gave no explanation for the decision and that the report contained unfair or biased comments. He also alleges that the report did not comply with the code of conduct for expert witnesses.
The Council allowed Tang to submit another expert report in response.
